Each state has between seven and nine MLAs for every Member of Parliament (MP) that it has in the Lok Sabha, the lower house of India’s bicameral parliament. There are also members in two unicameral legislatures in Union Territories: the Delhi Legislative Assembly and Puducherry Legislative Assembly.

The members of the Legislative Assembly are the direct representatives of the people of the states as they are directly elected by the citizens of the age group of 18 above the age of one state. Its maximum size has been determined by the Constitution of India which cannot have more than 500 or less than 60 members. However the size of the Legislative Assembly can be reduced by 60 members through an Act of Parliament: like Goa, Sikkim, Mizoram and Union Territory of Puducherry.

In some states, the Governor may appoint 1 member to represent minorities, e.g. the Anglo-Indian community if it believes that minorities have not received proper representation in the House. The person elected or appointed by the Governor is called the Member of Legislative Assembly or MLA.

The term of each Vidhan Sabha is for five years after which re-election takes place. During an emergency, its session may be extended or dissolved. Although a session of the Vidhan Sabha is for five years, it can be dissolved even before five years by the Governor at the request of the Chief Minister. The assembly session can be extended during an emergency but only for six months at a time. The Legislative Assembly can be dissolved even if a no-confidence motion is passed against a majority or coalition government.
